1. Terms of Use
1. All visitors and people using this web site must consent to these terms of use or must stop using this web site.
2. Visitors using free-of-charge public web pages must consent to the privacy notice.
3. Approved people using the private Bespoke Application Service must sign-in to consent to these terms of use.

2. Glossary:
Bespoke Application Service means the Internet-based application service specified by the Owner and operated by the Application Service Provider.
GDPR means General Data Protection Regulations as the primary UK law that governs the consent and operation of the Bespoke Application Service.

3. Parties:
1. Owner means the Data Controller as the company that specifies and uses their Bespoke Application Service to manage their business data.
2. Data Processor means the Application Service Provider (ASP) who operate the Bespoke Application Service for an on behalf of the Owner and Data Controller.

4. Bespoke Application Service:
1. The Owner company has the right to specify, alter and customise their Bespoke Application Service.
2. The Owner company has the right to save a copy of any web page as the generated HTML source code of their bespoke application service.
3. The Bespoke Application Service is the intellectual property of the Owner company.
4. The ASP shall operate the Bespoke Application Service in accordance with written directions of approved people acting on behalf of the Owner company.
5. The Owner company may choose to have their Bespoke Application Service provided as a monthly subscription service or as a free of charge service with unique terms of use.
6. The monthly subscription service is provided by the ASP for a month, is invoiced by the ASP on the first day of the following month and the Owner company will then pay for that months service during that month.
7. Where the Owner company chooses not to pay the ASP for the service provided, then the Bespoke Application Service was provided in accordance with the free of charge terms of use.
8. The free of charge service excludes the ASP from any and all liabilities towards the Owner company regarding the operation of the Bespoke Application Service and is paid for by advertising, marketing and associated services.
9. Both parties agree to fully conform with all UK laws and regulations including GDPR.

5. Subscription Business Model:
1. A critical benefit of the subscription business model is that continual improvement support requests are managed with urgency and without limit.
2. Provision of the Data Protection Officer with responsibilities to the ICO are included with a continually evolving Data Protection Impact Assessment.
3. Business continuity is 24*7 with data replicated to a large number of secure data centers that are used to provide a continual application service.
4. Business data is excessively encrypted to ensure that no business data can be stolen or lost. The threat of a reportable data breach has been eliminated.
5. Authentication is actively managed and monitored 24*7 to help those approved people who need assistance and to block and stop all criminal behaviour.

6. Free of Charge Business Model:
1. Support requests are managed as suggestions and deployed as and when adequate resourses are available without liability.
2. Business continuity is typically 24*7 but this is without liability of any kind.
3. The owner is undefined and undisclosed. In some cases the owner may be unknowable, may evolve and many be more than one organisation.
4. The Data Protection Officer takes no responsibility of the business data and has no liabilities for what is done with the business data.
5. Authentication is first class but may not be actively monitored 24*7.
